These Terms and Conditions ("Terms") govern your access to and use of the website, platform, and services provided by BSAi Global Limited ("Black Swan", "we", "us", or "our"). By accessing or using our services, you agree to be bound by these Terms. If you do not agree, please do not use our services.

• "Platform" refers to the technology infrastructure, APIs, dashboards, and tools operated by Black Swan.
• "Services" refers to the credit assessment, risk analysis, loan management, and related technology services we provide.
• "User" refers to any individual or entity that accesses or uses our Platform or Services.
• "Partner" refers to financial institutions, lenders, fintechs, and other organisations that integrate with or use our Platform.

Eligibility: You must be at least 18 years of age and have the legal capacity to enter into binding agreements to use our services.

Account Responsibilities: If you create an account on our Platform, you are responsible for maintaining the confidentiality of your credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorised use.

Black Swan is a technology infrastructure provider. We are not a bank, lender, or financial institution. We do not make lending decisions, extend credit, or manage loan accounts directly.

Our Platform enables Partner institutions to assess creditworthiness, manage lending operations, and deliver financial products. All lending decisions are made solely by the respective Partner institution. Any terms, rates, or conditions of a loan or financial product are set by the Partner, not by Black Swan.

All content, technology, trademarks, logos, and intellectual property on our Platform are owned by or licensed to BSAi Global Limited. You may not copy, modify, distribute, sell, or lease any part of our Platform or Services without our prior written consent.

By using our services, you agree to:

• Provide accurate, current, and complete information as required for the use of our services.
• Not use the Platform for any unlawful purpose or in a manner that could damage, disable, or impair our services.
• Not attempt to gain unauthorised access to any part of the Platform or its related systems.
• Not reverse engineer, decompile, or disassemble any aspect of our technology.

To the fullest extent permitted by applicable law, Black Swan shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from or related to your use of our services. Our total liability for any claim arising from these Terms shall not exceed the amount you have paid to us in the twelve (12) months preceding the claim.

Our services are provided on an "as is" and "as available" basis without warranties of any kind, whether express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not guarantee that our Platform will be uninterrupted, error-free, or secure at all times. We are not responsible for any decisions made by Partner institutions based on data or analysis provided through our Platform.

We may suspend or terminate your access to our services at any time, with or without cause, and with or without notice. Upon termination, your right to use the Platform ceases immediately. Provisions of these Terms that by their nature should survive termination shall remain in effect.

These Terms are governed by and construed in accordance with the laws of the Republic of Mauritius. Any disputes arising from or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of Mauritius.

We reserve the right to modify these Terms at any time. Changes will be posted on this page with an updated effective date. Your continued use of our services after any changes constitutes acceptance of the revised Terms.
